The petitioner has prayed for quashing of FIR No.78 dated 01.04.2019 for offence punishable under Sections 419/506 of the Indian Penal Code, 1860 and 67 of the Information Technology (Amendment) Act, 2008 registered with Police Station Civil Lines, Patiala, District Patiala and proceedings emanating therefrom on the basis of compromise arrived at between the parties.

A report dated 30.10.2019 has been submitted by the Judicial Magistrate Ist Class, Patiala, wherein it has been reported that statements of the petitioner and respondent No.2 have been recorded and statements made by the parties in the Court reveal that they have voluntarily entered into a compromise and the Court is satisfied that the parties have amicably settled their dispute without any fear, pressure, threat or coercion and out of their free will Counsel for the petitioner has submitted that no other criminal case is pending between the parties and the petitioner has not been declared as proclaimed offender.
(3.) Counsel for the petitioner has further submitted that the matter has been amicably settled and the petitioner is the only accused in the present FIR. It is also submitted that primarily, it was a matrimonial dispute of the victim - Arshpreet Kaur with the brother of the petitioner - Jasmeet Singh and in view of the compromise, the marriage between the complainant - Arshpreet Kaur with the brother of the petitioner - Jasmeet Singh, already stands dissolved by way of a decree under Section 13 of the Hindu Marriage Act on 10.01.2019. It is further argued that the FIR registered against the husband under Sections 406 and 498-A IPC stands quashed.
