JUDGEMENT

(1.) This petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus. It has been pleaded that after retirement from service while considering the case of the petitioner for pensionary benefits, excess amount in the context of retrenchee and special increments paid during the course of service is sought to be withdrawn by way of recovery.

(2.) Learned Counsel for the petitioner contends that the issue raised in this petition is covered by Judgment dated 27.5.2009 rendered by this Court in Civil Writ Petition No. 5568 of 2008 titled 'Charan Dass and Ors. v. State of Punjab and Ors.'.
