JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) The petitioner seeks pre-arrest bail in a case registered against her for the offences under Sections 498-A, 34 and 120-B IPC.

(3.) The FIR in the case arises out of a matrimonial dispute between Jaswinder Kaur-complainant and Jatinder Singh, son of the petitioner. The said dispute has been settled in terms of a compromise deed dated 18.7.2009 (Annexure-P.2). Jaswinder Kaur-complainant has deposed an affidavit dated 18.7.2009 (Annexure-P.3) accepting the compromise. On the basis of the compromise, Criminal Misc. No.M-30100 of 2009 has been filed seeking quashing of the FIR. The said petition has been adjourned to 16.8.2010 so as to enable Jatinder Singh and Jaswinder Kaur-complainant to obtain divorce by mutual consent for which a joint petition under Section 13-B of the Hindu Marriage Act ('Act' - for short) has been filed before the District Judge at Patiala. In terms of the compromise the complainant Jaswinder Kaur is to receive an amount of Rs.14 lakhs. The said amount is to be received at the time of second motion before the District Judge in a petition under Section 13-B of the Act.
