(1.) Learned Counsel for the Petitioner-tenant, on instructions from the Petitioner, seeks permission to withdraw this petition. He further states that he has instructions to undertake that tenant shall hand over vacant peaceful physical possession to the Respondent-landlady on or before 30.05.2011. He further undertakes on behalf of the Petitioner that manse profits at the rate of agreed rent shall be paid to the Respondent-landlady on or before 10th day of each and C.R. No. 7485 of 2010 every month. He further undertakes that entire arrears shall be paid to the landlady within four weeks from today.
(2.) Petition is dismissed as withdrawn. However, eviction order shall not be executed against the Petitioner-tenant till 31.05.2011 provided Petitioner furnishes undertaking in the shape of affidavit before the learned Rent Controller to the above effect within four weeks from today. It is made clear if undertaking is not furnished or any breach thereof is committed, then eviction order shall be executed forthwith.
