JUDGEMENT

(1.) HARPREET Singh, the husband, and Surjit Kaur, the mother-in-law of the deceased Manjinder Kaur, were convicted by the trial Court for the offence punishable under Section 304-B of the Indian Penal Code. Both of them were sentenced to seven years rigorous imprisonment. Of course, Malkiat Singh the father-in-law of the deceased was also arrayed as one of the accused but he was acquitted by the trial Court. Hence the appeal by the husband and the mother-in-law of the deceased.

(2.) THE brief case of the prosecution is as follows :

(3.) THERE was no representation on the side of the appellants-accused. The learned Deputy Advocate General appearing for the State would submit while referring to a decision of this Court that the facts and circumstances would go to show that Manjinder Kaur committed suicide. He would further submit that though the prosecution has failed to establish the case beyond reasonable doubt that Manjinder Kaur was done to death by the appellants. As there is evidence to show that there was a demand of dowry followed by cruelty, the suspicious death of Manjinder Kaur would fall squarely under Section 304-B IPC, he would further submit.
