(1.) IN the FIR, it is alleged that the petitioner, in conspiracy with two others, namely Vinod Kumar, Assistant Battery Attendant and Ashok Kumar working as a Clerk, provided undue favour to Vinod Kumar for getting his designation changed from Assistant Battery Attendant to that of a Clerk. For this purpose, the petitioner was to be paid a sum of Rs. 20,000/-. Vinod Kumar allegedly applied for change of designation. The Home Secretary marked the application to the Director, Transport, who in his report recommended that the request of Vinod Kumar cannot be entertained. The words "cannot be entertained" are stated to have been changed to "may be entertained". It is submitted by the counsel for the petitioner that the petitioner is the General Secretary of 'the U.T. Secretariat Employees Welfare Association'. Counsel for U.T. informs that nothing is to be recovered from the petitioner.
(2.) IN the above circumstances, I am of the considered opinion that nothing would be gained by sending the petitioner behind the bars. Consequently, the application for anticipatory bail is allowed. In the event of his arrest, the petitioner will be released on bail to the satisfaction of the Investigating Officer. Application allowed.
