(1.) Dharam Chand and others have filed the present revision petition to challenge the conviction and sentence recorded against them by the Additional Chief Judicial Magistrate, Rewari and modified by the Additional Sessions Judge-I, Rewari.

During the pendency of the revision the petitioners filed an application for bringing on record, Annexure P-1, a compromise which is stated to have been entered into between the petitioners on one side and the complainant on the other. According to this, the parties have sorted out the differences that arose between them and have agreed to move for compounding of the offences under Sections 325, 324 read with Sec. 34 Indian Penal Code, which were alleged to have been committed by the petitioners. Maman Singh, the complainant, has also filed an affidavit indicating that he has settled the dispute which existed between him and Dharam Chand and 2 others.

According to Sec. 320 Criminal Procedure Code, Sec. 323, Indian Penal Code can be compromised by the parties without the permission of the Court while Sec. 325 Indian Penal Code can be compounded with the permission of the Court. Since the parties are neighbours and have now put forth their willingness to resolve the differences between them in order to ensure complete harmony and good will, the interest of justice requires that they should be allowed to compound the offence under Sec. 325 Indian Penal Code.
