It is a case of prosecution that on 3.7.2000 at about 6.30 p.m. Jagga Singh son of Kashmir Singh, Saraj Singh son of Resham Singh, Krishan Kumar son of Amar Nath and Ramesh Kumar son of Ram Parkash were going in Maruti Car which was being driven by Ramesh Kumar. At that time, Saraj Singh was in possession of 12 bore DBBL gun. He was sitting on the front seat. When the Car reached near the grain market of village Kamala Bodla, a jeep of registered No. MP-09-S-1871 which was driven by Kuldeep Singh, was going ahead. Lakhwinder Singh alias Lakha and Puran Singh son of Jarnail Singh, Onkar Singh son of Lakhwinder Singh, Joginder Singh son of Gurmej Singh were sitting in the jeep. On seeing the car, Lakhwinder Singh accelerated the jeep and entered into the court yard of Baldev Singh. Petitioner Lakhwinder Singh was stated to be armed with 315 bore rifle and Onkar Singh was carrying a single barrel 12 bore gun while Puran Singh was carrying 12 bore gun with a short barrel and another accused Baldev Singh was armed with gandasi. When the Car reached near the house of Baldev Singh, he raised a lalkara that today Jagga Singh has come under their clutches and we have to teach a lesson for helping Joginder Singh at Kamala Bodla. Balwinder Singh, Puran Singh, Onkar Singh and Joginder Singh fired from their fire arms with their respective guns with intent to eliminate them.
(2.) Learned counsel for the petitioner submits that although the petition was armed with firearm yet no injury has been caused to the complainant party. It is also submitted by the learned counsel for the petitioner that even the complainant party returned the fire. Be that as it may, at present, prima facie it appears that the petitioners had taken law into their own hands in broad day light. In the interest of justice, prayer to grant bail is rejected Dismissed.
