VIKAS NAKRA Vs. STATE OF HARYANA

JUDGEMENT

(1.) IN this application, the petitioners seek grant of blanket anticipatory bail, in the event any of the officers from the State of Haryana, State of Punjab and Union Territory, Chandigarh wants to arrest the petitioners in connection with an offence of cheating. It is stated that during the year 1999, the petitioners came in contact with Puran Chand son of Kala Ram. Puran Chand told the petitioners that he is doing the business of travel agent and arranging Visas, Passport, employment in Canada, United States of America and England. The petitioner is said to have paid a sum of Rs. 6,00,000/- to Puran Chand for going abroad. Puran Chand in October, 1999 informed the petitioners that they have arranged for employment of the petitioner No. 1 in U.S.A. The petitioner was ultimately taken to Moscow, from where he was brought back as the travel documents were not complete. On his return, the petitioner demanded the refund of the money from Puran Chand. Despite repeated requests, the amount was not returned. Therefore, the petitioner moved a complaint against Puran Chand. Puran Chand agreed to refund Rs. 5,00,000/- on the condition that the complaint was withdrawn.

(2.) IT is further stated that the representatives of the Union Territory were not agreeable for withdrawal of the complaint. Inspite of that, the petitioners withdrew the complaint. Since then, according to the petitioners, Puran Chand and Karam Singh are absconding. They have, in fact, according to the petitioners gone abroad.

(3.) I have considered the submissions made by the learned Counsel. It is to be noticed that no FIR has been registered against the petitioners so far either in the State of Punjab or in the State of Haryana or in the Union Territory of Chandigarh. Apart from the assertions made in the petition, there is no material placed on the record which would justify the apprehension of the petitioners that they are sought to be apprehended by the police.
