THE petitioner by way of this petition under Section 407 read with Section 482 Cr.P.C. seeks transfer of the case from the Court of Chief Judicial Magistrate, Faridkot to any other Court of competent jurisdiction at Moga. In support of his case, Mr. Baldev Singh has submitted that there are three other Magistrates of competent jurisdiction who can try the present case, apart from Magistrate from whose Court, the case has been transferred. On the other hand, it has been brought to the notice of this Court by the respondent No. 1 that there are number of cases pending between the parties. The dispute relates to property of the family. He submits that three of the cases have been transferred and are pending in the Court at Faridkot. He further submits that he is in no manner responsible for delay in the finalisation of the cases. A perusal of the order passed by the District and Sessions Judge, Faridkot clearly shows that no irreparable loss has been caused to the petitioner by transfer of the case. In fact, it was necessary to transfer the case out of Moga, on the principle that justice must not only be done, but it must be seen to be done. In view of the above, I find no merit in this petition. Dismissed. Petition dismissed.
