(1.) Heard Shri P.K. Roy Choudhury, learned counsel for the petitioners. Also heard Ms. M.D. Bora, the learned State Counsel as well as Shri F.U. Borbhuiya, learned counsel appearing for the Respondent No. 4.
(2.) Considering the fact that this matter is pending since the year 2014 and also the nature of dispute, this writ petition is disposed of at the admission stage itself.
(3.) The petitioners (3 in nos.) claimed to be the registered owner of a plot of land which is described as Vita No. 89 under the Lanka Municipal Board, Nagaon. The initial allottee was the father of the petitioners, on his death, the petitioners were allotted the same vide order dated 15.09.2004. But financial hardship made them unable to run the business. Accordingly they requested the Chairman of the Lanka Municipal Board to give the premises on rent to the Respondent No. 4 so that in the meantime they are in a position to re-start their business. It is the case of the petitioners that though the tenure of the tenancy with the respondent no. 4 was for a period of 11 months, the said Respondent No. 4 had refused to vacate the premises after expiry of the tenure. The approach of the petitioners to the Lanka Municipal Board failing to yield any positive result, the petitioners had filed this writ petition with the following prayers:
