(1.) Heard Mr. J. I. Borbhuiya, learned counsel for the applicants/appellants. Also heard Ms. S. Jahan, learned Additional Public Prosecutor, Assam for respondent No.1, State and Mr. J. Kalita, learned counsel for the respondent No.2/ informant.
(2.) The applicants, namely, Mustt. Anju Bibi and Mustt. Hasina Begum are convicted accused of committing murder by assaulting their sister-in-law, Manjuwara Begum. Learned Session Judge, Nalbari by the judgment dated 08.07.2019 passed in Sessions Case No.101/2011, arising out of GR Case No.211/2010, corresponding to Nalbari P.S. Case No.97/2010, convicted both the applicants under Sections 302 / 201 IPC and sentenced them to undergo rigorous imprisonment for life with fine of Rs.10,000/-, in default of payment of fine to undergo rigorous imprisonment for further six months for committing the offence under Section 302 IPC and also sentenced them to undergo rigorous imprisonment for 3(three) years with fine of Rs.3,000/-, in default of payment simple imprisonment for 1(one) month for committing the offence under Section 201 IPC, thereof, where all the sentences to run concurrently, setting off the period of detention already undergone by them. The applicants are presently in District Jail at Nalbari, serving the sentences.
(3.) Against the said judgment of conviction and sentence dated 08.07.2019, the applicants preferred an appeal, being Criminal Appeal No. 281 of 2019 and it was admitted on 30.07.2019.
