GULAP HUSSAIN Vs. STATE OF ASSAM

JUDGEMENT

(1.) Heard Mr. PK Roychoudhury, learned counsel for the petitioners. Also heard Ms. A Begum, learned Additional Public Prosecutor, Assam, appearing for the State respondent.

(2.) By this application filed under Section 438 Cr.P.C., the petitioners, namely, 1. Gulap Hussain @ Gulab Hussain, 2. Anwar Hussain, 3. Jakir Hussain, 4. Ahmed Hussain, 5. Dilwar Hussain and 6. Abid Hussain @ Abid Ahmed have prayed for granting them pre-arrest bail apprehending arrest in connection with Harangajao PS Case No.01/2019 registered under Sections 366/34 IPC.

(3.) A perusal of the case diary reveals that the victim has been recovered and she is now with her mother. The victim is a major of above 35 years of age.
