(1.) The petitioners are unrepresented when the case is called. Therefore the relevant facts of the case are presented by Mr. D. Nath, the learned Addl. Sr. Govt. advocate, appearing for the respondents.
(2.) The matter pertains to recruitment and appointment of Armed Branch Constables in pursuant to the advertisement issued on 22/2/2009 (Annexure-1) by the IGP (Admn.), Assam Police. The petitioners offered their candidature, but failed to qualify and accordingly they challenge the selection process by projecting primarily that a large number of Schedule Tribe (Hill) category candidates were selected, for the vacancies in the North Cachar Hills district of Assam.

The Govt. advocate reads the counter affidavit filed by the respondent No.4 on 4/5/2010 to project that physical test and interview were conducted by the Recruitment Board in a transparent and objective manner and selection of 98 meritorious candidates out of the 304 candidates, who could qualify in the physical test were made on merit, with due regard to the reservation criteria. The counsel submits that a good number of ST(H) category secured higher marks than the general category candidates and therefore they were appointed on their own merit as is required, under the Assam Scheduled Caste and Scheduled Tribe (Reservation of Vacancies in Services and Posts) Act, 1979.
