(1.) Heard Mr. M.K. Choudhury, learned senior counsel for the petitioners, Dr. B. Ahmed, learned Standing Counsel for the Irrigation Department, Mr. B. Kaushik, learned counsel appearing on behalf of the respondents in the Director of Technical Education as well as Mr. R.K. Talukdar, learned counsel appearing for the respondent APSC.

The petitioners herein are all diploma holders in Civil Engineering/ Architectural Assistantship of the State Council for Technical Education, Assam and have also passed a three years Associate Membership Examination AMICE(I) in Civil Engineering from the Institute of Civil Engineers, India, which is stated to be located at Ludhiana in the State of Punjab.

The petitioners had participated pursuant to an advertisement dated 12.12.2013 issued by the Assam Public Service Commission for a selection in respect of, amongst others, 133 posts of Assistant Engineer (Civil) under the Irrigation Department. As per the result of the said selection procedure conducted by the APSC, the petitioners were selected for the aforesaid posts and their names appear at Sl No. 92, 68, 76, 94, 127 and 37 respectively. From the declaration of the result by the APSC, it is noticed that the Commission had recommended the candidates for the 133 posts in order of merit. Accordingly, it is the case of the petitioners that as there are 133 posts and the petitioners are within the selected 133 candidates, therefore, they are entitled to be issued with an appointment order.
