AJAY BHUSAN PAL Vs. STATE OF ASSAM

JUDGEMENT

(1.) THE petitioner in essence, seeks a writ of mandamus to the State respondents for considering him for promotion to the post of Principal, Polytenchic in the Assam Technical Education Service (hereinafter for short as 'service' ).

(2.) I have heard Mr. S. Shyam, learned counsel for the petitioner, Mr. U. K. Goswami, learned Standing Counsel, Education Department and Mr. S. Dutta, learned counsel for the Indian Council of Technical Education, New Delhi (hereinafer referred to as the 'council' ).

(3.) THE Council through its letter No. F. 6-6/89-T. 5/td. IV dated 20. 9. 1989 recommended the revision of pay scales of teachers of technical institutes (Polytechnics) laying down therein the qualification of the incumbents of various posts in such institutes. The essential academic qualification and experience for the post of Principal and Head of the Department, Polytechnic as enumerated therein were Ist Class Master's Degree in Engineering/technology/technical Education or Ph. D. Degree in appropriate branch for teaching posts in humanities and science together with 5 years experience in teaching, industry and research at the appropriate levels.
