JUDGEMENT

(1.) Heard Mr. T.J. Mahanta, learned Counsel appearing on behalf of the appellant as well as Mr. K.A. Mazumdar, learned Public prosecutor, Assam.

(2.) The conviction of the appellant, Ranjit Orang under section 302, I.P.C. and the resultant sentence to suffer rigorous imprisonment for life and a fine of Rs. 1,000.00, in default, further rigorous imprisonment for three months so handed down by the learned Adhoc Additional Sessions Judge, Jorhat, by his Judgment and Order dated 16.9.2002 rendered in Sessions Case No. 98 (J.J.)/2000 has been assailed in this Criminal Appeal from jail.

The prosecution case in a short campus may be noticed as under: On 14.6.2000. one Thanu Orang (the deceased), a resident of Namsinga Bongali Gaon, P.S.-Teok, went to his garden along with a labourer to trim the branches of trees. He involved in a quarrel with Bigwa Orang and Ranjit Orang (the appellant) in the vicinity of the said garden over the trimming of branches of trees of his garden. The quarrel had turned violent gradually and the appellant brutally beat Thanu Orang, who died in the spot itself. An 'ejahar' was lodged with the police on the same day by the informant PW-3 (Smt. Surjyaboti Orang), the wife of the deceased and a police case was registered being Teok P.S. Case No. 63/2000 under sections 320/34, I.P.C. against the appellant and investigation ensued.
