SURMAN ALI LASKAR Vs. STATE OF ASSAM

JUDGEMENT

(1.) This Civil Rule relates to Constitution of Managing Committee of Mehrab Ali Laskar Memorial High School.

(2.) The Inspector of School, Cachar District Circle Silchar by Memo No.9 CH/l/97/9238- 40 Dated Silchar the 30th Jan/97, reconstituted the managing committee of the school with person enumerated therein. The legitimacy of the Constitution of the said Managing Committee, particular about the selection of the President impugned in this proceeding.

(3.) The Inspector of Schools, Cachar District Circle, Silchar by its communication dated 8.1.97 addressed the Headmaster/Secretary Mehrab Ali Laskar Memorial High School, P.O.-Nair-gram and Majaid Ali Rural High School, P.O- Bhaga Bazar regarding constitution of the Managing Committee of the School. By the said letter the Inspector informed the respective Headmaster/Secretary that since the school has been accorded recognition up to class VIII by the Department therefore as per the rules the Managing Committee was to be constituted for the respective Schools as per Departmental Type-plan (Norms). By the said communication the Secretary was requested to submit necessary proposal for constitution of the Managing Committee within the specified date. In pursuance of the aforesaid direction the general meeting in connection with the reconstitution of the Managing Committee of the Mehrab Ali Laskar Memorial High School was held on 19.1.97 at the premises of the School building. In the said meeting of the guardians, donors, teachers and general public of the village Neairgram Pt.I and II assembled and by the resolution No.1 the managing committee was reconstituted with the following members. "..l. Surman Ali Laskar -President 2. Ramiz Uddin Mazumdar - Secretary 3 .Safique Uddin Mazumdar - Teacher representative 4.Abdul Aziz Laskar - General Member. 5. Abdul Monim Laskar - General Member (Donor) 6. Firoz Ahmed Mazumdar - Guardian Member 7. Hurmat Ali Laskar - Guardian Member 8. Smt.Alema Aktara Begum - Female Member 9. Moin Uddin Laskar - Nominated Member lO. Nachir Uddin Mazumdar -Nominated Member 11 .Khalilur Rahman Laskar - Nominated member. Sd/- 20.1.97 President of the Gen, Meeting The said resolution of the general meeting dated 19.1.97 was forwarded to the Inspector " of School, Cachar District Circle by the Secretary, Mehrab Ali Memorial High School, Meairgram vide communication dated 20.1.97. The Inspector of Schools, Cachar District Circle reconstituted the Managing Committee vide order dated 30.1.97 accepting the reconstitution of the Managing Committee as per the general meeting save and except the Presidents instead one Shri Sarfat Ali Laskar was selected by the Inspector as the President keeping in tact the other recommendation. Hence the Writ Petition.
