JUDGEMENT

(1.) Heard Mr. N.C. Das, learned senior counsel assisted by Mr. A. Das, learned counsel appearing for the appellant. Also heard Mr. D. Mazumdar, learned senior counsel assisted by Mr. D. Chakraborty, learned counsel representing respondent no. 4 as well as Mr. A.B. Choudhury, learned senior counsel and Ms. P. Chakraborty, learned counsel representing respondent nos. 9 and 19.

(2.) This appeal has been preferred against the purported final decree dated 19/11/2009 passed by the learned Civil Judge No.1, Cachar, Silchar in connection with Title Suit No. 23/1987.

(3.) This litigation has a chequered history and for the purpose of proper appreciation of the legal issues involved herein, a brief narration of the factual back-drop is deemed necessary.
