JUDGEMENT

(1.) THE petitioner is aggrieved by forfeiture of his seniority in the division in which he is presently working as Lower Division Assistant (LDA). Same was done while transferring him from one division to another on the ground that the petitioner made request for his transfer to the present division.

(2.) SHORTLY stated, the facts leading to filing of the instant writ petition are that the petitioner was initially appointed as LDA in the office of the Executive Engineer, Goalpara Investigation Division by order dated 4.5.1978. The petitioner joined the service on 9.5.1978.

(3.) AFTER working at Goalpara for a couple of years, the petitioner was transferred to Kokrajhar E and D Circle and he -remained there from 8.1.1991 to 1.1.2002. By Annexure -3 office order dated 31.10.2002, the petitioner was transferred to Goalpara E and D Division with the following conditions:
