(1.) The petitioner in this petition under Article 226 of the Constitution of India was at fkst entered into the service in the month of My, 1954 as Assistant Teacher under the then Relief & Rehabilitation Department and while he had been serving as such the Education Section of the Relief & Rehabilitation Department merged into the Education Department of the Government of Tripura and was placed under the Director of Education, Government of Tripura.

The petitioner's case was that while he was rendering his services as Assistant Teacher he; was deputed to undergo Crafts Training at Crafts Teachers Training Centre at Agartala, a Government of Tripura establish- ment and after completion of one year training there the petitioner passed the final examination in Carpentry and he was placed in Second Class. He was also granted a certificate to the same effect (Annexure-A). Thereafter, the petitioner was appointed Crafts Instructor in 1959 in the scale of pay of Rs. 100-160/- (Annexure-B).
(3.) In the year 1963 the Government Employees were granted revised scale of pay with effect from 1-4-1961 under the Tripura Employees Revision of Pay and Allowances (Rules), 1963. In the said revision two scales of pay were provided for the Crafts Instructors, viz. Rs. 175-325/- for those who got First Class Certificate in Crafts Teachers training and Rs. 125- 200/- for those having practical experiences only. This pay revision did not provide any scale for the Crafts Teachers who obtained Second Class Certificate. So, the petitioner alike many others were given the lower scale of pay of Rs. 125-200/- with effect from 1-4-1961. Subsequent to this pay revision there had been successive revisions of pay tor the Tripura Government Employees including Crafts Instructors with effect from 1-3-74. 1-1- 1982 and again from 1-1-1986. But inspite of these revisions the pay scales of the Crafts Instructors having Second Class Certificate were not made equal to those having First Class Diploma/Certificate.
