JUDGEMENT

(1.) Heard Mr. B. Banerjee, learned senior counsel for the appellants. None appears for the respondents.

(2.) This appeal by the plaintiff is preferred against the judgment and decree dated 29.6.2005 passed by the learned Civil Judge (Senior Division), Golaghat in Title Appeal No. 16/2004 reversing the judgment and decree dated 18.10.2004 passed by the learned Civil Judge (Junior Division), Golaghat in Title Suit No. 10/2002, whereby suit of the plaintiff was decreed.

(3.) Though it was not specifically mentioned in the judgment of the learned trial court that the counter-claim was rejected, in view of the decision in issue No. 7 rejecting the claim of the defendant for compensation, it must be taken that the counter-claim was dismissed.
