(1.) Following question has been referred to by a learned single Judge for our decision:
(2.) The word 'court' has been defined under the Code of Civil Procedure (hereinafter referred to as 'the C.P.C.'). Section 3 of the Code merely states about the subordination of courts.
(3.) In the case of Brajanandan Sinha v. Jyoti Narain, AIR 1956 SC 66, the Apex Court held that the expression 'courts subordinate to the High Court' would prima facie mean the courts of law subordinate to the High Court in the hierarchy of courts established for the purpose of administration of justice throughout the Union. 3.1.
