(2.) This appeal has been directed against the judgment and order dated 20.12.96 passed by learned Sessions Judge, Cachar, Silchar wherein the accused appellants were convicted u/s 304 Part 11/149 IPC.
(3.) It was an unfortunate incident on the night of Kalipuja, in the year 1994. According to Hindu mythology Kali, means triumph cover the evils. However, in the name of Puja two groups of young men stated a quarrel as a result of which one young life was lost. The deceased Sanjay Kumar Roy, a young boy aged about 26 years, sustained fatal injuries and died. Post mortem examination was conducted by Dr. K. K. Chakravorty, PW 13 who found the following injuries: Injuries:
