RAJENDRA NAIK Vs. STATE OF ASSAM

JUDGEMENT

(1.) Heard Mr. S.C. Biswas, learned counsel for the applicant and also heard Ms. N. Das, learned Additional Public Prosecutor for the State respondent.

(2.) This application, under Sec. 438 Cr.P.C., is filed by applicant, Shri Rajendra Naik, who has been apprehending arrest in connection with Noonmati P.S. Case No. 263/2022, under Sec. 379 IPC, for grant of pre-arrest bail.

(3.) It is to be noted here that Noonmati P.S. Case No. 263/2022, under Sec. 379 IPC, has been registered on the basis of an F.I.R. dtd. 6/4/2022, lodged by Sonu Giri on 2/6/2022 to the effect that on that day at about 12-14 a.m., his father's 12 wheeler truck bearing registration no. AS-01-GC/6624 is stolen from Zoo Narengi road near Gate Hospital, Guwahati and as per the GPS report, the truck was located at about 02-19 a.m. at Borkukuria NH-27.
