JUDGEMENT

(1.) BY this revisional application, filed under Section 397 r/w Section 401 of Cr.P.C., the petitioner challenged the judgment & order, dated 23.07.2004, passed by learned Sessions Judge, Goalpara in Criminal Appeal No.1/2002 affirming the judgment & order of conviction and sentence, dated 14.12.2001, passed by learned Additional Chief Judicial Magistrate, Goalpara in G.R. Case No.10/1997.

(2.) THE accused -petitioner, Amarendra Das, was charged for commission of offence punishable under Sections 279/337/427/304(A) of I.P.C and on trial, learned Additional Chief Judicial Magistrate found him guilty of committing offence punishable under Sections 279 and 304 -A of I.P.C and accordingly, sentenced him to suffer S.I for 2(two) months and to pay a fine of Rs.500/ -, in default to suffer SI for 10(ten) days u/s 279 of I.P.C and again to suffer SI for 6(six) months and to pay a fine of R.1,000/ - (Rupees one thousand), in default to suffer SI for 1(one) month under section 304(A) of I.P.C.
