(2.) The present petition has been filed challenging the order dated 30.01.19 passed by the learned Member, Foreigners' Tribunal-III, Barpeta in F.T. Case No. 1444(III) of 2013 Ref. IMDT Case No. 1550/03 opining the petitioner as an illegal migrant and consequently declared the petitioner as a foreigner u/s 2(a) of the Foreigners Act, 1946.

The Tribunal took up the matter on a reference being made by the Superintendent of Police (B), Barpeta against the present petitioner, namely, Haider Ali, S/o- Harmuz Ali, of village No.12 Kawaimari under P.S. Sarthebari, District Barpeta, Assam. On receipt of notice from the Tribunal, the petitioner appeared before the Tribunal on 11.06.2018 and submitted his written statement along with supporting documents to substantiate his claim that he is an Indian citizen.
