ALL the case indicated above have arisen on account of registration of Noonmati P.S.Case No.127/2011 U/ss. 120(B)/306 IPC on the basis of the FIR lodged by Dr.Pranjal Bharali with the Officer-in-charge, Noonmati P.S., on 24.4.2011 on account of commission of suicide by his wife, namely, Monalisa Bharali on the night of 22.4.11. Since the facts involves in all the 3 cases are similar and the relief(s) sough for being also similar, all the cases are taken up together for disposal by this common order.
(2.) WE have heard learned counsel for the petitioners in each of the cases and Mr. B.B.Gogoi, learned Addl. P.P.Assam for the State respondent. It is also to be mentioned here that a similar FIR was also filed with the Officer-in-charge, Noonmati P.S. by the eldest daughter of Dr. Pranjal Bharali, the first informant on account of death of her mother, Monalisa Bharali on the night of 22.4.11. Both the FIRs having been received, a similar case number was recorded and registered U/s. 120(B)306 IPC.

THE learned counsel for the petitioners, therefore, submitted that the facts and materials appearing in the face of the record do not justify the rejection of the applications filed U/s. 438 CrPC. Contrary to the submissions advanced by the learned counsel for the petitioners, Mr. B.B.Gogoi, learned Addl. P.P. representing the State respondent submitted that the statements of the witnesses so far recorded by the I.O. indicate that while the deceased along with her family members on the relevant time visited the house of her brother-in-law for a family function, Sri Parag Saikia, his wife and their two daughters along with others, who are all related to Monalisa Bharali (deceased) humiliated her very severely assailing her character. When the family function was over, they all returned home and at about 2.30 AM on the same night said Monalisa Bharali got herself ablazed by pouring kerosene on her body who subsequently succumbed to injuries. It is submitted by Mr. B.B.Gogoi, learned Addl. P.P. Assam, that on account of humiliation assailing Monalisa Bharali's character, she being unable to bear such humiliation took the extreme step. He also submitted that Monalisa Bharali committed suicide on account of such humiliation by the petitioners and for which the petitioners would not be entitled to privilege of pre-arrest bail.
