JUDGEMENT

(1.) The Appellants Rana Prasad Das and Tapan Mandal were put on trial in the Court of learned Sessions Judge, West Tripura, Agartala, in case No. ST44(WT/A) of 2004, for commission of offence under Sections 302 and 201 of the IPC. By the impugned judgment and order Appellant Rana Prasad Das was convicted under Section 302 and 201 IPC and was sentenced to undergo imprisonment for life for commission of offence under Section 302 and also to pay a fine of Rs. 5000/- with default stipulation of two months imprisonment and further sentenced to suffer RI, for five years and to pay a fine of Rs. 1000/- with default stipulation of one month's imprisonment, for commission of offence under Section 201 of the IPC.

(2.) However, co-accused Shri Tapan Mandal, who was convicted under Section 201 IPC and sentenced to undergo RI for five years and to pay a fine of Rs. 5000/- has not preferred any appeal against the order of conviction and sentence imposed on him by the learned trial Court.

(3.) We have heard Mr. Arijit Bhowmik, learned Counsel, appearing on behalf of the accused-Appellant and Mr. D Sarkar, learned Public Prosecutor, with Mr. RC Debnath, learned Spl. P.P., representing the State Respondent. We have also gone through the impugned judgment and the evidence on record.
