JUDGEMENT

(1.) Heard Mr. S. S. Goswami, learned counsel for the petitioner. Also heard Mr. R.Mazumdar, learned Standing counsel, Elementary Education Department, appearing for the respondents.

(2.) In this writ petition the petitioner has challenged the order dated 15.07.2017 (Annexure-11 of the writ petition) passed by the Commissioner and Secretary to the Government of Assam, Education (Elementary) Department, by which the claim of the petitioner for arrear salary had been rejected.

The case of the petitioner is that vide an order dated 25.03.1999 (Annexure-2) issued by the Director of Elementary Education, Assam, he was initially appointed as an Assistant Teacher in Satgari Govt. M.E. School, in the district of Darrang, Assam, under Operation Black Board (OBB) Scheme against an allotted post. By the same order dated 25.03.1999, the petitioner was attached to Khandajan M.E. School in the same district. The petitioner joined his service on 26.03.1999. Thereafter, by an order dated 20.10.2000 the petitioner was transferred to Maroi M.V. School. However, it appears that the petitioner did not join Maroi M.V. School and remained unauthorizedly absent w.e.f. 21.01.2001, as reported by the Headmaster of Maroi M.V. School.
