(1.) Heard Mr. S.K. Nath, learned counsel for the petitioner. Also heard Mr. D. Bhattacharjee, learned counsel for the respondent APDCL.
(2.) The father of the petitioner who was an employee under the APDCL died on 08.07.2014 in a motor cycle accident near his home. Upon his death, the petitioner made an application for compassionate appointment on 06.12.2014. On the death of the father of the petitioner, the respondent APDCL conducted their own enquiry including police verification etc., and arrived at their conclusion that the father of the petitioner had met with a motor cycle accident when he was not in the duty of the company.

In the aforesaid circumstance, the order dated 28.04.2016 was passed that as the father of the petitioner had died when he was not in the duty in the company therefore, under the APDCL Compassionate Appointment Scheme 2014, he would neither be entitled to any appointment nor he would be entitled to any of the ex gratia payable to an employee who dies in a motor cycle accident while in duty. By arriving at such conclusion by the order dated 28.04.2016, the claim of the petitioner stood rejected.
