JUDGEMENT

(1.) THE following order of the commission was delivered by Smt. Neerja Singh Member : Mrs. Neerja Singh, MemberBy this complaint, the complainant has alleged negligence against the respondent doctor in performing a D&C operation, which resulted in injury. She has sought compensation of Rs. 6,73,000.

(2.) THE facts in brief, as depicted by the complainant, Smt. Poonam Prajapati, are that on the advise of respondent No. 2, Dr. Rashmi Sharma, she was admitted in Mungee Nursing Home on 3.7.2000, with complaint of excessive bleeding. A D and C was done, but some complications occurred due to deficiency on the part of the doctor. The operation was done again on 4.7.2000 in the evening. After that she had abdominal distension. Sonography was carried out and she was kept under observation. Dr. Rakesh Agrawal, surgical specialist, who was called advised laprotomy, for which he advised shifting her to his nursing home. She was discharged on 5.7.2000 from Mungee Nursing home.

(3.) THE complainant further states that when Dr. Rakesh Agrawal performed the operation, he found that the peritoneal cavity was full of semi digested faecal material and blood. It was found that the gut was completely torn and it was repaired carefully in layers. She later developed faecal fistula, which further complicated matters.
