JUDGEMENT

(1.) THIS appeal under Section 15 of the Consumer Protection Act, 1986 is directed against the order dated 24.8.2002, in Complaint No. 58/2002 by District Consumer Disputes Redressal Forum, Raipur (hereinafter called the District Forum for short) directing the appellant/Electricity Board to adjust the excess amount of Rs. 17,647/ - realized towards electricity charges from the complainant/respondent.

(2.) INDISPUTABLY , the complainant/respondent is a Small Scale Industrial Unit under the name and style of Jayesh Iron Foundry. It is not in dispute that the sanction load of the electric connection of the said unit was 13 HP.

(3.) ACCORDING to the complainant/respondent, the appellant officers inspected the unit on 26.2.2000 and reported that upper portion of the unit was being utilised for commercial purpose. Accordingly, additional bill for Rs. 5,487/ - on the basis of tariff applicable to commercial unit, was demanded from the complainant. Thereafter electricity charges on the basis of commercial tariff were demanded and an amount of Rs. 17,647/ - was realized from the complainant.
