JUDGEMENT

(1.) This Public Interest Litigation has been filed by the petitioner seeking direction for constitution of Court monitored Special Investigation Team or appointing an independent investigation agency like CBI or any other Special Investigation Team to conduct an enquiry regarding irregularities and illegalities committed in the utilization of the public funds and for an enquiry against the erring officials who are responsible for the mis-utilisation of public funds by an independent investigation agency and to launch criminal prosecution against them if their complicity is made out.

The case of the petitioner is that the Central Government has launched a scheme namely Rashtriya Krishi Vikash Yojana hereinafter called as RKVY scheme with an object of improving Agricultural Sector in terms of identification of suitable local crops as per geo-climatic parameters and enhancing their yields by providing adequate infrastructure or improving existing ones. Under the RKVY scheme, the Central Government has set up fund which could be availed by the State as additional assistance to the State plan scheme in respect of agriculture and allied sectors.

(3.) The petitioner has sought information from the Nodal Agency of RKVY, State of Manipur, regarding the funds and its beneficiaries, but the Nodal Agency has not been able to furnish any information and they have been evasive, passing the buck from one to another. When the petitioner conducted survey in respect of RKVY scheme and its sub scheme to gather information in respect of its awareness and impact, he came to know that most of the people have not heard of the scheme and none has received any benefits in any form from such schemes.
