JUDGEMENT

(1.) Heard Mr. D. Julius Riamei, learned counsel appearing for the petitioner and Mr. B.R. Sharma, learned CGSC appearing for the respondents.

The learned counsel appearing for the petitioner submitted that by an order dtd. 24/5/2025 issued by the Commandant, 68th Battalion, SSB, Debendranagar, the petitioner has been imposed the penalty of retirement from service w.e.f. 24/5/2025. It has also been submitted by the learned counsel for the petitioner that against the said order, the petitioner has preferred a statutory appeal as provided under Rule 29 of the SSB Rules, 2009 and the said appeal is still pending for consideration and disposal by the appellate authority. The learned counsel submitted that the present writ petition may be disposed of by directing the Deputy Inspector General (Admn.) Frontier Headquarter (FTR), Sashastra Seema Bal (SSB), Tezpur, Assam, to consider and dispose of the said appeal within a stipulated period.

(3.) Mr. B.R. Sharma, learned CGSC appearing for the respondents fairly submitted that the present writ petition may be disposed of as prayed for by the learned counsel appearing for the petitioner. However, the learned CGSC submitted that atleast three months' time be given to the said appellate authority to consider and dispose of the said statutory appeal. Considering the submission made by the learned counsel appearing for the parties, this court is of the considered view that it will be in the interest of justice to issue the following directions:-
