JUDGEMENT

(1.) Mr. Th. Kunjaraj, learned counsel appeared on behalf of the petitioner; Mr. S. Jasobanta, learned counsel appeared on behalf of the respondent no. 1; and Mrs. L. Monomala, learned GA appeared on behalf of the respondent nos. 2 to 5.

(2.) It has been submitted by the learned counsel appearing for the parties that this matter was earlier referred for mediation proceeding and thereafter a report has been submitted that the mediation was unsuccessful.

(3.) In view of the above, the learned counsel appearing for the parties submitted that this matter may not be referred for mediation and the matter be heard on merit.
