Decided On December 07, 2015
Mrs. Adim Kamei Appellant
V/S
THE STATE OF MANIPUR Respondents

JUDGEMENT

(1.) Wife of the detenu has filed this writ petition challenging the order of detention passed by the District Magistrate, Churachandpur directing detention of her husband in exercise of the power conferred u/s 3(2) of the National Security Act, 1980 by order dated 13th May, 2015.

(2.) Mr. H. Komol, learned counsel appearing for the petitioner assailed the impugned order of detention solely on the ground that there was inordinate delay in disposal of the representation of the detenu and reliance is placed on two decisions by the learned counsel appearing for the petitioner in support of his submission.

(3.) Mr. A. Vashum, learned G.A. appearing for the state respondents submitted that there was delay of 15 days in disposal of the representation and such delay having been explained, it cannot be said to be inordinate delay. He also relies upon a decision of the Apex Court where in delay of 12 days in disposal of the representation was not held to be inordinate delay.
