BY filing this petition under Article 226 of the Constitution of India, the petitioner prays that the bills for a total sum of Rs.14,55,715/ -, which, according to him is undisputed one are not being paid by the respondents/State despite repeated representations made by the writ petitioner from time to time and hence this writ petition under Articles 226 of Constitution of India for issuance of writ of mandamus against the respondents for release of the amount claimed.

IT is the case of the petitioner that they did some civil work which was awarded to him by the State Government and despite completion of the work in terms of the contract by the writ petitioner and submitting the bills for the work done, the State Government is not releasing the money and hence the petitioner is has filed strained to file this writ petition under Article 226 of the Constitution of India against the respondent -State authorities directing them to pay/release the amount raised by the petitioner in the form of the aforesaid bills.

LEARNED counsel for the petitioner therefore submits that the case of the petitioner should be examined by the State authority in the light of the guidelines contained in the Full Bench decision in Shri LS Punii (supra), and if on verification, it is found that unpaid bills of the petitioner satisfy the guidelines, then the outstanding amount claimed in the bills may be paid to the petitioner.
