JUDGEMENT

(1.) BY filing this petition under Article 226/227 of the Constitution of India, the petitioners pray that their bills for a total sum of Rs.15,60,483/ -(Rupees fifteen lakhs sixty thousand four hundred and eighty -three), (Annexure A/1 colly) which, according to them is undisputed one is not being paid by the respondents/State despite repeated representations made by the writ petitioners from time to time and hence this writ petition under Articles 226/227 of Constitution of India for issuance of writ of mandamus against the respondents for release of the amount claimed in their bills.

IT is the case of the petitioners that they did some civil works which were awarded to them by the State Government and despite completion of the works in terms of the contract by the writ petitioners and submitting the bills for the works done, the State Government is not releasing the money and hence the petitioners are constrained to file this writ petition under Articles 226/227 of the Constitution against the respondent - State authorities directing them to pay/release the amount raised by the petitioners in the form of the aforesaid bills.

LEARNED counsel for the petitioners therefore submits that the case of the petitioners should be examined by the State authorities in the light of the guidelines contained in the Full Bench decision in Shri LS Punii (supra), and if on verification, it is found that unlaid bills of the petitioners satisfy the guidelines, then the outstanding amount claimed in the bills be paid to the petitioners.
