JUDGEMENT

(1.) THIS Review Petition is filed under Order 47 Rule 1 of C.P.C. by the respondent of Writ Appeal No.87 of 2009, which was allowed by the Bench comprising Mr.Justice Maibam BK Singh and Mr. Justice Mutum BK Singh on 28.5.2010. Since the learned Judges constituting the Bench are not available to hear this review, both having demitted the office on attaining the age of superannuation and hence the application for Review is placed before this Bench for hearing.

THE respondent (writ petitioner) filed a writ petition being WP(C) No. 91/2009 against the Review petitioner (M.P.S.C.) and some private respondents for setting aside of the recruitment process for the post of Government College Lecturers in Computer Science and also sought quashing of notification dt. 15.12.2008 issued in that behalf. The writ petition, on contest, was dismissed by the Single Judge by order dt. 16.11.2009. The writ petitioner felt aggrieved filed WA No.87/2009 out of which this Review Petition arises. The appellate court by order dt. 28.5.2010 allowed the appeal and while setting aside of the writ court's order, allowed the writ petition and set aside the notification impugned therein. The Review Petitioner felt aggrieved of the appellate court, filed SLP No.16833/2010 in the Supreme Court. The Supreme Court by order dt. 14.10.2011 dismissed the SLP finding no merit therein. It is then, the Review Petitioner felt aggrieved and filed this Review Petition against the appellate order. It may be mentioned that no liberty was obtained from the Supreme Court for filing Review Petition.

(3.) HAVING heard the learned counsel for the Review Petitioner and on perusal of the record of the case, we find no merit in the Review Petition. In our opinion, there exist no error much less apparent error within the meaning of order 47 Rule 1 so as to recall the impugned order.
