BY filing this petition under Article 226/227 of the Constitution of India, the petitioner prays that their bills for a total sum of Rs.71.75/ -(Rupees Seventy one Lakh and Seventy Five Thousand only), (Annexure A/2 to the writ petition), according to him is undisputed one is not being paid by the respondents/State despite repeated representations made by the writ petitioner from time to time and hence this writ petition under Articles 226/227 of Constitution of India for issuance of writ of mandamus against the respondents for release of the amount claimed in his bills.

IT is the case of the petitioner that he did some works civil work awarded to them by the State pursuant to a contract entered into by the State Government with him and despite completion of such work and submitting the bills for the work done, the State Government is not releasing the money and hence the petitioner is constrained to file this writ petition against the respondent - State authorities directing them to pay/release the amount raised by the petitioner in the form of the aforesaid bills.

LEARNED counsel for the petitioner therefore submits that the case of the petitioner should be examined by the State authority in the light of the guidelines contained in the Full Bench judgment rendered in the case of Shri LS Punii (supra), and if on verification, it is found that unpaid bills of the petitioner satisfy the guidelines contained in the said decision, then the outstanding amount claimed in the bills may be paid to the petitioner.
