CHITRESWORI KHUNDRAKPAM Vs. UNION OF INDIA

JUDGEMENT

(1.) The Director, Regional Institute of Medical Sciences, Imphal (RIMS in short), issued Advertisement dtd. 16/5/2016 calling for applications for appointment to the post of Tutor, Dental College, RIMS, Imphal. In the said Advertisement, the qualification required for the post of Tutor, Dental College was BDS Degree of an Indian University or equivalent qualification with one year experience. The petitioner being qualified, applied for the post of Tutor, Dental College, (OBC). By a Notice dtd. 11/7/2016, the Director, RIMS, Imphal published the list of eligible candidates for the post of Tutor, Dental College, RIMS. In the said Notice, 7 (seven) candidates were found eligible amongst which, the name of the petitioner appear at Sl.No.4. By another Notice dtd. 20/7/2016 the Director, RIMS Imphal informed that the Interview for the post of Tutor, Dental College, RIMS will be held on 23/7/2016 at 11.00 AM. Thereafter, the Deputy Director (Admn) RIMS, Imphal, submitted the proceedings of the Selection Committee Meeting held on 23/7/2016 for appointment of Tutor, Dental College, RIMS, Imphal to the Secretary (H&FW), Ministry of Health & Family Welfare, Government of India by letter dtd. 26/7/2016. In the said letter, it is indicated that the post of Tutor, Dental College, RIMS is Group-A. However, the composition of the Selection Committee is for Group-B posts and Tutor approved in the 46th Meeting of the Executive Council, Society of RIMS, Imphal held on 20/10/2015. The proceedings of the Selection Committee Meeting held on 23/7/2016 was also enclosed in the said letter dtd. 26/7/2016. In the Proceedings of the Selection Committee, the name of the petitioner was recommended for appointment as Tutor, Dental College, RIMS on regular basis.

(2.) The Sec. Officer (NE), Government of India, Ministry of Health and Family Welfare wrote a letter dtd. 8/8/2016 addressed to the Director, RIMS, Imphal stating that on perusal of the letter dtd. 26/7/2016, that some points have emerged for clarification and the contents of the letter is reproduced herein below:
