JUDGEMENT

(1.) The petitioner has challenged the order dated 21.9.2016 passed by the second respondent, whereby the second respondent issued orders to the effect that the claim of the petitioner for grant of grade pay of Rs.4400/- under ACP-II shall be considered as and when existing grade pay of BDO (Jr) is revised to Rs.4400/- under ROP-2010. The petitioner also seeks direction on the respondents to allow him to enjoy the grade pay of Rs.4400/- under ACP-II, as the said grade pay was being enjoyed by the BDO (Jr) of the RD and PR Department, Government of Manipur.

The case of the petitioner is that he was serving as Village Level Worker (VLW) on regular basis for the last 31 years in the Department of Rural Development and Panchayat Raj, Government of Manipur. As per the ACP Scheme framed by the State Government, the petitioner was entitled to the ACP-II with effect from 16.06.2010 and accordingly, he was given the revised scale of pay of Rs.5500-175- 9000/-. Thereafter, the said scale of pay has been revised to Rs.9300- 34800/- with grade pay of Rs.4400/- which is equivalent to the scale of pay of BDO (Jr) which has been included in the cadre of Junior MCS. Without giving any opportunity of being heard, the Director, RD and PR issued a corrigendum whereby the scale of pay of VLW was given as Rs.9300-34800/- with grade pay of Rs.4300/-.

Aggrieved by the corrigendum, the petitioner has filed W.P.(C) No.477 of 2014 challenging the same and the writ petition came to be disposed of by this Court with a direction to the petitioner to submit a fresh representation to the authorities by making his claim and the respondents were directed to consider the same by a speaking order. The petitioner also filed review petition and the same was also disposed of with a direction that if the petitioner is not satisfied with the order of the authorities, he would be at liberty to approach the Court again. On 21.9.2016, the second respondent issued an order that the claim of the petitioner for grant of grade pay of Rs.4400/- under ACP-II shall be considered as and when the existing grade pay of BDO (Jr) is revised to Rs.4400/- under ROP-2010, which is challenged in the present petition. According to the petitioner, the BDO (Jr) is enjoying the grade pay of Rs.4400/-.
