JUDGEMENT

(1.) The petitioner, who was a candidate for selection of anganwadi worker, has approached this Court, by way of filing this writ petition, to quash the selection of opposite party no.4 as anganwadi worker in respect of Narangochha-V anganwadi centre of Dasarathpur village in the district of Jajpur, vide Annexure-2 dated 26.09.2017, and also the order dated 04.07.2018 passed by the Addl. District Magistrate, Jajpur in rejecting the A.W.W. Misc. Appeal Case No.02 of 2018 preferred by her.

The factual matrix of the case, in hand, is that the Child Development Project Officer (CDPO), Dasarathpur Block issued an advertisement bearing no.325 dated 26.04.2017 for appointment of anganwadi worker in respect of Narangochha-V anganwadi centre of Duduranta Gram Panchayat. Pursuant to such advertisement, the petitioner, along with four others applied for. But, at the time of document verification, as one of the candidates remained absent, altogether four candidates took part. The petitioner belonged to general category, whereas opposite party no.4 belonged to scheduled caste category. At the time of verification of certificates, only the petitioner and opposite party no.4 produced their testimonials before the concerned authority to be eligible for the post. A comparative statement of mark sheet of eligible candidates was prepared by opposite party no.1 on 26.09.2017 and as opposite party no.4 secured higher marks than the petitioner, she was selected and engaged as anganwadi worker in respect of Narangochha-V anganwadi centre of Duduranta gram panchayat.

(3.) Ms. S. Pattnaik, learned counsel for the petitioner strenuously urged that the methodology adopted by the authority for calculation of marks is absolutely erroneous and thus the entire selection has been done contrary to the guidelines issued by the Government. Therefore, she seeks for quashing of the selection of opposite party no.4 and also the order passed by the Addl. District Magistrate in Annexure-1, and issue a direction to give appointment to the petitioner as anganwadi worker in respect of Narangochha-V anganwadi centre.
