JUDGEMENT

(1.) THOUGH the matter was listed for orders, on the consent of the learned counsel for the parties, the same was taken up for hearing and final disposal.

(2.) THIS revision has been filed challenging the order dated 21.7.2003 passed by the learned C.J.M. -cum -Asst. Sessions Judge, Jeypore in S.C. No.24 of 2001.

(3.) IN order to prove its case, prosecution has examined as many as 14 witnesses and exhibited several documents. Out of the said witnesses, P.W.1 was the Police A.S.I., P.W.2 was the informant, P.W.3 is the daughter of the informant, P.W.4 is the wife of the informant, P.W.5 is a post -occurrence witness, P.Ws.6 and 7 were witnesses to the seizure of articles under Section 27 of the Evidence Act, P.W.8 was the scribe of the F.I.R., P.W.9 was an occurrence witness, P. W. 10 is the doctor who examined the informant and others P.W.11 was the Magistrate who conducted the T.I. Parade of suspects, P.W.12 was the Investigating Officer, P.W.14 was a witness to the seizure of currency notes, P.W.13 however turned hostile.
