JUDGEMENT

(1.) The petitioner Shri Dinabandhu Naik was retired by an order (Annexure 1) of the Government of Orissa in the Revenue Department on 16/17-1-1974. The order runs thus:

(3.) As the Committee observed that the character roll for the year 1972-73 was not available to them, we called for the character rolls from 1972 onwards. The character rolls depict a very sorry picture of the officer in unequivocal terms. The Collector and the Commissioner under whom the officer worked stated that his honesty was questionable and he was a highly undesirable officer. The subsequent character rolls which were not available to the Committee from 1972 onwards did not mark any departure from the antecedent character rolls which were taken into consideration. Any way it was open to the Committee to consider the character roll that was available to them at the time of consideration, and non-consideration of the subsequent character roll which was clearly adverse does not vitiate the recommendation.
