(1.) The petitioner was appointed as a clerk in the office of the District Judge, Koraput, Jeypore and he joined service on 18-12-1959. His appointment was purely temporary and terminable at any time without previous notice (see Annexure-1). He was removed from service by an order of the District Judge on 31-10-1972 by Annexure-2. The impugned order runs thus:
(2.) Mr. Mohanty for the petitioner raised three contentions:
(3.) The facts on the basis of which the termination order was passed have been indicated in the writ application itself. It appears that the District Judge went on inspection of the Magistrate's Court at Gunupur under whom the petitioner was working. As usual,, the Registrar of the District Judge went to prepare the notes of inspection for the District Judge. He found out that the petitioner was in charge of general files of the Court of the Sub-Divisional Magistrate, Gunupur, and he did not put up about 373 cases before the Presiding Officer on the dates fixed. He did not maintain any diary in respect of the cases he had to handle and he had kept pending about 1100 cases without dealing with them. He did not issue summons and did not attend to those records and consequently those cases could not be made ready for trial. On a previous occasion the petitioner had been orally warned and he had been directed to make his seat up-to-date. Taking these facts into consideration the District Judge approved the inspection note prepared by the Registrar and passed the impugned order terminating the services of the petitioner.
