(2.) Learned counsel for the petitioner submitted that the petitioner has filed a petition under Sec. 125 Cr.P.C. being Cr.P. No.10 of 2024 before the Court of learned Judge, Family Court, Paralakhemundi on 13/2/2024. Pending consideration of said petition, the petitioner was served with a notice issued from the Court of learned Judge, Family Court-II, Bhubaneswar, which is a notice from her husband, relating to C.P. No.326 of 2024 by which, he seeks restitution of conjugal rights under Sec. 9 of the Hindu Marriage Act, 1955. He further submits that the civil proceeding being instituted in the Court of learned Judge, Family Court-II, Bhubaneswar, which would be inconvenient for attending each and every date by travelling around 200 kilometers (From Paralakhemundi to Bhubaneswar). Therefore, the petitioner prays for transfer of the C.P. No.326 of 2024 pending in the Court of learned Judge, Family Court-II, Bhubaneswar to the Court of learned Judge, Family Court, Paralakhemundi.
(3.) Issue notice to the opposite party by Registered post/Speed post with A.D., requisites for which shall be filed within seven working days. Notice be issued fixing a short returnable date.
