BENUDHAR SOURA Vs. STATE OF ODISHA

JUDGEMENT

(1.) This matter is taken up through a hybrid arrangement.

(2.) The Petitioners, being in custody in connection with Nabarangpur P.S. Case No.207 of 2024 corresponding to T.R. Case No.09 of 2024 pending in the court of learned Sessions Judge-cum-Special Judge, Nabarangpur for the offences under Ss. 20(b)(ii)(C) of the NDPS Act, has filed this application for release on bail.

(3.) The brief fact of the case is that on 2/5/2024 while the informant along with other staffs were performing patrolling duty at Indrabati Naka Check post, they noticed three persons were going in a navy blue colour Scooty from Boriguma side and one of them was holding one plastic gunny bag in his lap. It is alleged that when the informant gave signal to stop the vehicle but the rider tried to fled in a high speed. The police staff chased them and apprehended all three persons. They disclosed their names as Benudhar Soura, Aman Khan and Hafiz Khan. On being searched the informant found 26 Kg. 140 grms of ganja from the Jarry Bag.
