SANDEEP PRABODH KERKETTA Vs. STATE OF ODISHA

JUDGEMENT

(1.) This is an application under Sec. 439 of Cr.P.C. filed by the petitioner-Sandeep Prabodh Kerketta for bail in connection with C.T.(S) Case No.02 of 2021 arising out of Nalco Township P.S. Case No.131 of 2020 for commission of offences punishable under Ss. 302/34 of IPC, pending in the Court of learned Addl. Sessions Judge (Vigilance), Angul.

(2.) Mr. Manas Kumar Chand, learned counsel for the petitioner submits that due to certain unavoidable circumstances, the doctor (P.W.12), who has conducted postmortem examination of the deceased could not be cross-examined by the defence, for which an application had been filed in this court, namely, CRLMC No.2858 of 2023 and this Court has permitted cross examination of the doctor (P.W.12) on virtual mode.

Considering the above circumstances, the bail application is disposed of granting liberty to the petitioner to move for bail before the learned trial Court after cross-examination of P.W.12 which shall be considered in accordance with law, without being influenced by the earlier order of rejection.
